After a marriage ends, former spouses may find love again with new partners and decide to remarry. However, remarriage may affect the legal issues from a person's marriage.

Impact of Remarriage on Alimony

For a spouse supported by alimony payments, it will end as soon as the remarriage is official. However, alimony won't legally end until the obligor spouse files a motion with the court to have his or her support obligation terminated.

On the other hand, an obligor spouse's wedding often doesn't affect alimony payments. Although household expenses generally increase with remarriage, courts typically do not reduce an obligor spouse's alimony payment because of it.

Impact of Remarriage on Child Support

Remarriage alone is not enough to justify a modification of child support. A child's right to financial support from both parents doesn't end because a parent remarries. However, a parent's child support obligation may be adjusted if his or her remarriage also includes the addition of a new baby. According to New Hampshire law, a parent's child support obligation may be adjusted when new children are born.

Impact of Remarriage on Child Custody

A parent may wish to relocate with the child or change the child's living arrangements-to accommodate a new party-by seeking a modification. A parent cannot obtain a modification without the other parent's consent unless the court finds a significant change in circumstances which would have an impact on the child's best interests. If both parents agree to a new arrangement, they may be able to determine new custody and visitation terms without court proceedings.
